Terms of Service

Summary

These terms govern your use of Evigate. Key points: you keep all rights to the content you upload; Evigate produces draft answers that a human must review before use (we never auto-send anything); paid plans are billed through Paddle as our merchant of record; the service is provided "as is" within the limits of Indian law; and you can delete your data and stop using the service at any time.


1. Agreement to terms

These Terms of Service ("Terms") form a binding agreement between you (and the organization you represent) and Logethos, a sole proprietorship based in Surat, Gujarat, India ("Evigate," "we"). By creating an account or using the service you accept these Terms, the Privacy Policy, the Acceptable Use Policy, and the AI Usage Policy. If you are accepting on behalf of an organization, you represent that you are authorized to bind it.

2. The service

Evigate is an AI-powered platform that drafts answers to security questionnaires (SIG, CAIQ, and custom formats), grounded in evidence you upload, with a citation on every confident answer and the option to abstain when the evidence does not support an answer. Core capabilities include evidence ingestion, retrieval, cited answer drafting, a human review workflow, a reusable answer library, projects, data export, and bring-your-own-key (BYOK) support.

Some capabilities are planned but not yet available, including a browser extension, a public API, and multi-user team roles; nothing in these Terms is a commitment to ship them.

3. Eligibility and accounts

You must be at least 18 and able to form a binding contract. One organization is created per signup (the service is single-user-per-organization at this time). You are responsible for the accuracy of your registration details, for keeping your credentials secure, and for all activity under your account. Authentication is by email and password, or optionally "Sign in with Google" (OAuth 2.0 / OIDC) where the operator has configured it; we do not offer any other third-party single sign-on (no SAML) at this time. Notify us promptly at security@logethos.com of any unauthorized use.

4. Your content and license to us

You retain all rights to the evidence, questionnaires, answers, and other materials you upload or generate ("Customer Content"). You grant us only the limited, non-exclusive license needed to host, process, transmit, and display Customer Content for the sole purpose of providing the service to you, including sending the minimum necessary data to our AI and embedding subprocessors as described in the AI Usage Policy. This license ends when you delete the content or your organization.

We do not use Customer Content to train AI models, and we do not sell it. You represent that you have the rights necessary to upload your Customer Content and that it does not violate the Acceptable Use Policy.

5. Drafts require human review

Evigate produces draft answers intended for human review. The service does not auto-submit or auto-send answers. You are solely responsible for reviewing, correcting, and approving any answer before you rely on or submit it. AI output can be incomplete or wrong; you must not treat a draft as a final, authoritative, or legally binding statement without your own verification. See the AI Usage Policy.

6. Acceptable use

Your use must comply with the Acceptable Use Policy. In short: do not break the law, infringe others' rights, upload content you have no right to, attempt to access other tenants' data, probe or disrupt the service, or evade usage limits and cost controls.

7. Bring your own keys (BYOK)

You may supply your own API key for Anthropic, OpenAI, Gemini, a local Ollama endpoint, or a custom OpenAI-compatible endpoint. When you do, the corresponding AI calls run on your provider account, under your agreement with that provider, and you bear that provider's cost and terms. Data sent through a non-Anthropic BYOK key is governed solely by your agreement with that provider, not by Evigate's agreements with its own AI subprocessors. Embeddings are never BYOK — they always run on our local platform model. We store BYOK keys encrypted at rest, use them only to make calls on your behalf, never return them to your browser, and never log them. You are responsible for the validity and entitlements of keys you provide.

8. Plans, billing, and taxes

  • Plans. We offer a Free plan and a paid plan. **Free and paid differ only by

    usage limits; every feature works on both.** Current limits and the price are shown on the Pricing page and in the Billing Policy.

  • Merchant of record. Paid subscriptions are sold and processed by

    Paddle, our merchant of record. Paddle is the seller of record for your purchase, handles payment processing and collects/remits applicable taxes, and its terms apply to the payment transaction.

  • Renewal and cancellation. Paid subscriptions renew automatically each

    period until cancelled. You can upgrade or cancel anytime from Settings → Billing. Cancellation takes effect at the end of the period you have already paid for, not immediately: you keep your paid limits until that date and are not charged again. Cancellation stops future renewals and your data is retained, not deleted, on downgrade.

  • Non-payment. If a payment fails, your account may enter a grace period and

    then be limited to Free-plan limits until resolved.

  • Refunds. Paid fees are non-refundable except for billing errors and

    non-waivable statutory rights; the Free plan includes every feature so you can evaluate before paying. See the Refund Policy.

9. Self-hosted deployment

If you deploy Evigate in your own infrastructure ("self-hosted"), you are responsible for the operating environment, the third-party providers you configure (including AI/embedding/payment/email vendors and your own API keys), security hardening, backups, and updates. Self-hosted use is governed by these Terms and the Licensing terms; the SLA commitments for the hosted service do not apply to self-hosted instances, which run under your control.

10. Intellectual property

The Evigate service, software, and brand are owned by us and our licensors and are protected by law. Except for the rights expressly granted here (and any applicable open-source license, see Licensing), we grant you no rights in our intellectual property. You may not copy, reverse engineer, or create derivative works of the service except as permitted by law or an applicable open-source license. Feedback you provide may be used by us without obligation.

11. Third-party services

The service relies on third-party providers (see Subprocessors). Their availability and terms are outside our control; we are not liable for their acts or omissions beyond our own responsibilities as described here and in the DPA.

12. Warranty disclaimer

To the maximum extent permitted by law, the service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that AI-generated drafts are accurate, complete, or suitable for a particular questionnaire or audit. You assume responsibility for your review and use of all output.

13. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the service and these Terms will not exceed the greater of the amounts you paid us for the service in the twelve (12) months before the event giving rise to the claim, or INR [LIABILITY_CAP_INR]. These limits do not apply to liability that cannot be excluded under applicable law.

14. Indemnification

You will defend and indemnify Evigate against third-party claims arising from your Customer Content, your use of the service in violation of these Terms or the Acceptable Use Policy, or your violation of law or another's rights.

15. Suspension and termination

You may stop using the service and delete your organization at any time. We may suspend or terminate access if you materially breach these Terms or the Acceptable Use Policy, if required by law, or to protect the service or other users. Where practical we will give notice. On termination you may export your data for a reasonable period before deletion; deleting your organization is permanent.

16. Changes to the service or terms

We may modify the service and may update these Terms. Material changes will be posted here with a new "last updated" date and noted in the changelog. Changes are effective when posted; continued use after that constitutes acceptance.

17. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. The courts of Surat, Gujarat, India have exclusive jurisdiction, subject to any mandatory consumer-protection rights you have in your country of residence.
